TERMS AND CONDITIONS OF THE „MADAME DU BARRY“ ONLINE STORE
1. General Provisions
1.1. These Terms and Conditions for the Purchase and Sale of Goods (hereinafter – the Terms), once approved by the Buyer (by purchasing goods and clicking the "Confirm Order" button), constitute a legally binding document for both parties. It establishes the rights and obligations of the Buyer and the Seller, the conditions for acquiring and paying for goods, delivery and return procedures, the liability of the parties, and other provisions related to purchasing from the online store. 1.2. The Seller is MB "Madame Du Barry". 1.3. The Seller reserves the right to change, amend, or supplement the Terms at any time, taking into account the requirements established by legal acts.
2. Protection of Personal Data
2.1. Any information related to personal data registered in the online store shall be processed in compliance with confidentiality principles and shall not be disclosed to the public, except as provided by the laws of the Republic of Lithuania. The Seller complies with the General Data Protection Regulation (GDPR).
3. Buyer's Rights
3.1. The Buyer has the right to purchase goods in the online store in accordance with the procedure established by these Terms. 3.2. The Buyer has the right to withdraw from a distance contract without giving a reason within 14 (fourteen) days from the date of receiving the goods (pursuant to Article 6.22810 of the Civil Code of the Republic of Lithuania). 3.3. The Buyer may exercise the right provided in clause 3.2 only if the goods have not been damaged, have not lost their commercial appearance (labels not removed, protective films intact), and have not been used (worn).
4. Buyer's Obligations
4.1. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Terms. 4.2. The Buyer undertakes to protect their login data and not disclose it to third parties. In case of data loss, the Seller must be informed immediately. 4.3. By using the e-shop, the Buyer agrees to these Terms and undertakes not to violate the legal acts of the Republic of Lithuania.
5. Seller's Rights
5.1. If the Buyer attempts to undermine the stability or security of the online store, the Seller has the right to restrict the Buyer's access without prior notice. 5.2. The Seller has the right to cancel an order if the Buyer, having chosen payment by bank transfer, fails to pay for the goods within 3 (three) business days.
6. Seller's Obligations
6.1. The Seller undertakes to respect the Buyer's privacy and protect their personal information. 6.2. The Seller undertakes to deliver the ordered goods to the address specified by the Buyer or to the selected parcel locker. 6.3. In the event that the Seller is unable to deliver the ordered goods due to unforeseen circumstances, the Seller undertakes to offer an analogous product or refund the money paid by the Buyer within the specified time limit.
7. Prices of Goods and Payment Procedure
7.1. Prices of goods are specified in Euros (EUR). 7.2. The Buyer can pay for the goods using the following methods: 7.2.1. By bank transfer to the account of MB "Madame Du Barry". 7.2.2. By card via the Shopify system. 7.2.3. Via the MakeCommerce.lt platform (Swedbank, SEB, Luminor, Citadele, Šiaulių bankas). 7.3. Refunds (in case of transaction withdrawal) shall be processed within 7 business days from the date of receiving the returned goods.
8. Delivery of Goods
8.1. The Buyer undertakes to provide an accurate delivery address and contact phone number. 8.2. Delivery terms are indicated in the descriptions of the goods. If the delivery is delayed due to unforeseen circumstances, the Seller will inform the Buyer personally. 8.3. Upon receiving the shipment, the Buyer must check the condition of the packaging. If damage is noticed, it must be noted on the courier's delivery slip or a damage report must be filled out.
9. Return of Goods
9.1. Returned goods must be unused, undamaged, and in their original packaging (with all labels attached). The Buyer is responsible for the proper assembly and packaging of the returned goods. 9.2. Goods are returned at the Buyer's expense, except in cases where defective goods are being returned. 9.3. The returned shipment must include the order sheet, invoice, or the specified order number so that we can identify the Buyer. 9.6. Upon receiving and checking the returned goods, the money will be refunded to the Buyer within 7 business days.
10. Quality Guarantee and Liability
10.1. The features of each item are indicated in its description. The Seller is not responsible if the color on the screen may slightly differ from the real color due to the settings of the Buyer's device. 10.2. The Buyer is fully responsible for the accuracy of the provided data. 10.3. In the event of damage, the guilty party shall compensate the other party for direct losses in accordance with the procedure established by the laws of the Republic of Lithuania.
11. Final Provisions
11.1. These Terms and Conditions are drawn up in accordance with the legal acts of the Republic of Lithuania. 11.2. All disagreements shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be settled in the courts of the Republic of Lithuania or through the State Consumer Rights Protection Authority.
